Sunshine Coast Council received a complaint from one of Jacqueline’s neighbours about shipping containers.

Sunshine Coast Council issues a Show Cause Notice for the illegal use of three shipping containers a shed used for commercial purposes. The Show Cause notice stated:

  • Council received three complaints about shipping containers, the construction of tiny houses on wheels on the premises, commercial storage and habitation of a bus with awning and tiny house on premises.

  • In accordance with Sunshine Coast Planning Scheme 2022 the storage used described above is defined as a “Warehouse” which in accordance with the tables of development assessment requires impact assessable material change of use development approval for Council within the prevailing '“Rural” zone.

  • The shipping containers have been on the premises since approximately October 2021. It is apparent that the shipping containers are intended to be permanently used for commercial storage which is assessable development un the Building Act 1975 requiring Building Works approval. Notwithstanding the land use “Warehouse” use issue, permanent use of the shipping containers to store personal goods requires building approval from a Private Building Certifier which much comply with the Building Act 1975 and relevant Council policies.

  • No record can be found of any material change of use or building works development approvals authorising “Warehouse” use or for the shipping containers.

The council indicated that Jacqueline’s response to the April Show Cause was unsatisfactory, hence the decision to issue another Show Cause.

This Show Cause indicated they had received three complaints about shipping containers on the premises, the construction of tiny houses on wheels, commercial storage and the habitation of a bus with an awning and tiny house on the premises.

The Tiny Community Living Campaign commenced with community members emailing the CEO of SCC asking them to suspend the Establishment & Occupation of a Temporary Home local law and ensure the new town plan reflects how the community wishes to live.
